Terms, Conditions & Privacy Policy

This document constitutes a binding legal agreement between you (hereinafter, the "User") and the creators of Remember Moon. By downloading, installing, accessing, or using the Remember Moon mobile application (the "Application"), you agree to be fully bound by these Terms, Conditions, and Privacy Policy.

PART I: TERMS AND CONDITIONS OF USE

1. Acceptance and Eligibility

By using the Application, you represent and warrant that you have sufficient legal capacity to bind yourself under these terms. The use of the Application is free and at your own sole responsibility.

2. Description of the Service and License of Use

Remember Moon is a personal tracking tool (transit journal), astrological consultant, and real-time celestial event visualizer (ephemeris). We grant you a limited, non-exclusive, non-transferable, and revocable license to download and install a copy of the Application on your personal mobile device for your private, non-commercial use.

3. Intellectual Property

All elements making up the Application (programming code, designs, graphical interfaces, logos, icons, texts, astrological calculation methodologies, and trademarks) are our exclusive property or we hold the corresponding licenses. It is strictly prohibited to copy, decompile, modify, disassemble, or reverse engineer the Application without our prior written authorization.

4. No Obligation to Maintenance, Support or Continuity

• Support not guaranteed: Although we strive to provide an optimal experience, we assume no legal obligation to provide guaranteed updates, maintenance, technical support, or bug fixes.
• Right to discontinue: We reserve the unilateral right to modify, suspend, interrupt, or completely discontinue the Application at any time, temporarily or permanently, without incurring any liability.
• "As-Is" Use: The Application is delivered "as is" and "as available". We do not guarantee uninterrupted operation or compatibility with future updates of operating systems (iOS/Android).

5. Local-First Approach and User Data Responsibility

The Application operates under a local-first storage principle. This means that:

• No cloud storage by default: All your data (journal entries, moods, birth data, and settings) is stored directly in the local storage space of your device.
• Data loss: In the event of loss, theft, physical damage to the device, accidental deletion of system data, or uninstallation of the Application, all your records will be permanently lost.
• Backups: You are solely responsible for generating backups of your data using the export tools provided by the Application. We do not have access to your data and cannot recover it for you.
• Export for Analysis and Third-Party Use (including AI): The Application allows you to export your logs in text formats (CSV, JSON, TXT) optimized for analysis or importing into external tools (such as third-party language models or AI assistants). By performing this export, you assume full responsibility for the security, storage, and destination of those files. If you decide to upload your information to third-party artificial intelligence platforms, spreadsheets, or cloud services, the processing of your data will be subject to the privacy policies of those providers. We do not control or take responsibility for the use, storage, model training, or potential leaks that occur on external platforms.
• Forgetting the Security PIN: If you choose to enable the access PIN to protect your privacy, you are solely responsible for remembering and safeguarding it. Due to the local architecture of the Application, we do not store your PIN on any server and do not have a mechanism to reset it remotely or recover your access. If you forget your PIN, we will not be able to help you recover your account or your data. In that scenario, the only technical alternative to use the Application again will be to uninstall it, which will lead to the permanent loss of all your local entries and configurations.

6. Astrological and Well-being Disclaimer

Astrological information, transits, natal charts, and any other suggestions provided by the Application are generated for recreational, informative, and self-reflection purposes only. No content in Remember Moon should be interpreted as professional advice of a medical, psychological, financial, or legal nature.

7. Limitation of Liability

Remember Moon shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Application, unauthorized access to your device, or technical failures beyond the system's control.

8. Payments, Subscriptions, and Refunds

The processing of all payments, in-app purchases, and subscriptions is done through the official distribution platforms (Apple App Store and Google Play Store). We do not collect or store credit card data or financial information. Any refund requests, subscription cancellations, or billing disputes must be managed directly by the User with Apple or Google, governed by the terms and conditions of those app stores.

9. Third-Party Services and APIs

The Application requires services provided by third parties for certain features (such as city geocoding and native iOS/Android speech-to-text). We do not guarantee the continuous, error-free, or uninterrupted availability of these external services. Remember Moon will not be liable for any technical failures, disconnections, unavailability, or malfunctions of external services that affect the performance of the Application.

10. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Argentine Republic. Any dispute, controversy, or claim arising out of or relating to the use of the Application shall be submitted exclusively to the jurisdiction of the ordinary courts of the Autonomous City of Buenos Aires (CABA), the User waiving any other jurisdiction that might correspond to them.

PART II: PRIVACY POLICY

1. Core Principle: Privacy by Design

At Remember Moon, we deeply value your privacy. The Application is designed under the principle of privacy by design: your journals, emotional logs, and birth information are not transmitted to databases managed by us, and you are not required to register with an email address or social networks to use the main features.

2. Information We Collect and Process

To calculate and draw your Natal Chart and interact with transits, we ask you to enter: birth date, birth time, and birth place. This data is processed solely and exclusively at a local level using astronomical algorithms. It is not sent to any external server.

Your personal reflections and daily emotions are saved in the secure, local database of the Application (SQLite/Drift). They are not accessible or visible to us or third-party companies.

To obtain the coordinates (latitude and longitude) of your birthplace, the application makes a specific query to an external web service solely to resolve the geographical location and time zone of the place instantly. We do not track your GPS location in real-time or associate the query with your identity.

Audio processing is performed entirely locally using the native services of the operating system (iOS/Android). We do not send or store voice recordings on external servers.

The user may voluntarily choose to export their entries to perform pattern analysis in external tools or artificial intelligence (AI) models. This action is carried out under the absolute responsibility of the user. Remember that once you download your data from the Application and share it with third-party platforms, we have no control over how those companies process, store, or use your writings.

3. Data Security

• Access Security PIN: You can configure a 4-digit PIN code within the app to protect your private data from unauthorized physical access to your phone. Note: This PIN is stored in an encrypted and local format on your device; we do not have access to it, nor can we reset it if forgotten.
• Operating System Protection: The local database is isolated and protected thanks to the native sandboxes of iOS and Android.

4. Complete Control and Data Deletion

You can modify or delete your entries manually at any time. If you decide to permanently delete all your historical information and data stored in Remember Moon, simply uninstall the Application from your device.
